1. Acceptance of These Terms
These Terms and Conditions (“Terms”) are a binding agreement between you and Gibbas Inc., doing business as SportsCred (“SportsCred,” “we,” “us,” or “our”). They govern the SportsCred mobile application, website, landing-page quiz, and related services (together, the “Service”).
By creating an account, accessing, or using the Service, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 13 years old to use the Service. If you are under the age of legal majority where you live, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. You may not use the Service if applicable law prohibits you from doing so.
The Service may not be available in every location. You are responsible for following the laws that apply where you access it.
3. Accounts and Security
You must provide accurate information, keep your sign-in credentials confidential, and promptly notify us of suspected unauthorized use. You are responsible for activity under your account unless prohibited by law.
Handles must follow our format rules and may not impersonate SportsCred, another person, a team, a league, a media outlet, or a public authority. We may reserve, reclaim, or change handles to prevent confusion, abuse, or infringement.
You may not sell, rent, transfer, share, or create accounts in bulk. One person may not use multiple accounts to manipulate ACS, matches, validation, reports, or any other feature.
4. License to Use the Service
Subject to these Terms, SportsCred grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to access and use the Service for lawful, noncommercial purposes.
You may not copy, modify, distribute, sell, lease, reverse engineer, scrape, automate access to, or attempt to extract source code from the Service except where applicable law expressly permits it. You may not bypass access controls, rate limits, scoring rules, kickoff locks, or security measures.
For an iOS download, Apple’s Standard Licensed Application End User License Agreement applies to the license for the app unless SportsCred provides a valid custom EULA through the App Store. These Terms additionally govern the SportsCred account and online Service.
5. Community Rules and Prohibited Conduct
You agree not to:
- harass, threaten, bully, stalk, exploit, or encourage harm toward another person;
- post hate speech, sexual exploitation, unlawful sexual content, graphic violence, doxxing, or content that violates another person’s privacy;
- post spam, scams, malware, deceptive promotions, unauthorized advertising, or misleading links;
- impersonate others or falsely suggest endorsement, affiliation, verification, or official status;
- infringe copyrights, trademarks, publicity rights, or other rights;
- cheat, collude, exploit bugs, use bots, manipulate response timing, reveal answer keys, coordinate fake validation, or otherwise distort ACS, picks, trivia, matchmaking, or leaderboards;
- submit false or abusive reports, evade blocks or enforcement, or create replacement accounts after suspension;
- probe, disrupt, overload, or gain unauthorized access to the Service, accounts, or data;
- use Service data to profile, discriminate against, or make decisions about credit, employment, housing, insurance, education, or other regulated eligibility; or
- use the Service for unlawful gambling, money laundering, or any illegal purpose.
Football discussion can be heated; disagreement is allowed. Abuse, threats, manipulation, and rights violations are not.
6. User Content
“User Content” includes posts, replies, profile information, images, links, reports, feedback, and other material you submit. You keep ownership of your User Content.
You grant SportsCred a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, adapt for formatting and accessibility, publish, display, distribute, and otherwise use User Content as needed to operate, secure, moderate, improve, promote, and provide the Service. This license ends when the content is deleted from our active systems, except where continued use is technically necessary, legally permitted, or the content has been shared by others outside our control.
You represent that you have all rights needed to submit User Content and grant this license. You are responsible for your User Content and the consequences of posting it.
Moderation
We may review, filter, limit distribution of, label, preserve, remove, or disable access to User Content, and may restrict accounts, when we reasonably believe it violates these Terms, creates risk, infringes rights, or harms the Service. We are not obligated to monitor every item and cannot guarantee that all objectionable content will be removed immediately.
Users can report posts and block human authors. Reporting a post may hide it from the reporter. Blocking affects visibility and certain future interactions. We may preserve moderation records and scoring references when necessary to maintain platform integrity.
Copyright complaints
If you believe material on the Service infringes your copyright, send a written notice to thesportscred@gmail.com containing: your physical or electronic signature; identification of the copyrighted work; identification and location of the challenged material; your contact information; a good-faith statement that the use is not authorized; and a statement under penalty of perjury that the notice is accurate and you are authorized to act for the rights holder.
SportsCred may remove challenged material and terminate repeat infringers where appropriate.
7. ACS, Picks, Trivia, and Sports Data
ACS is a platform reputation score only. The Athletic Credibility Score (ACS), related points, tiers, labels, validation weights, and leaderboards have no cash value, are not property, cannot be transferred or redeemed, and are not consumer credit scores or measures of personal worth.
ACS is calculated by server-side rules that may consider quiz results, settled picks, validated takes, match outcomes, moderation outcomes, integrity signals, and administrative corrections. We may correct errors, reverse abuse, adjust formulas prospectively, recalibrate scores, or retire features. We will not intentionally fabricate a user’s sports record, but the Service may contain delays or errors.
Picks lock according to the Service’s recorded kickoff time. Picks, odds, implied probabilities, news, scores, schedules, and other sports data may come from third parties and may be delayed, incomplete, or inaccurate. They are provided for discussion and entertainment, not as financial, gambling, legal, or professional advice.
SportsCred is not a sportsbook. The Service does not accept wagers, hold betting funds, pay gambling winnings, or guarantee prizes. Do not use SportsCred where doing so would violate gambling or contest laws.
Trivia questions and grading may contain errors. You may not copy, distribute, scrape, sell, or publish the question bank or unrevealed answer keys.
8. SportsCred AI Content
The Service may publish automated posts that are visibly labeled “SPORTSCRED AI.” AI content is not a human user, has no ACS, and may summarize sports news or game results from third-party sources. It can be incomplete or wrong. Verify important information with the original source.
You may reply to or dispute eligible AI content through the available features. Do not treat AI output as professional advice or an official statement from a league, team, player, or news provider.
9. SportsCred and Third-Party Rights
The Service, excluding User Content and identified third-party materials, is owned by SportsCred or its licensors and is protected by intellectual-property laws. SportsCred’s name, logos, visual design, software, scoring presentation, and original content may not be used without permission.
NFL, team names, logos, player names, news, statistics, schedules, and other third-party materials belong to their respective owners. SportsCred is an independent fan platform and is not endorsed by, sponsored by, or affiliated with the National Football League, its clubs, or any referenced media or data provider unless we expressly say otherwise.
10. Apple and Google
If you download the app through Apple’s App Store or Google Play, you must also comply with that platform’s applicable terms. The platform provider is not responsible for SportsCred’s online Service, User Content, moderation, support, or claims relating to the Service except as its own terms require.
Apple and its subsidiaries are third-party beneficiaries of the provisions applicable to an iOS app license and may enforce those provisions. SportsCred, not Apple, is responsible for maintenance and support for the SportsCred Service.
11. Suspension, Termination, and Account Deletion
You may stop using the Service at any time and may delete your account through the Profile area. Deletion is irreversible and may remove your ACS, ledger, profile, posts, replies, picks, match history, and other account-linked records, subject to limited lawful retention described in the Privacy Policy.
We may warn, restrict, suspend, or terminate access; remove or preserve content; invalidate activity; or take other reasonable action if we believe you violated these Terms, created risk, manipulated the platform, or exposed SportsCred or others to harm or liability. Where appropriate, we may provide notice and an opportunity to appeal.
Sections that by their nature should survive termination—including ownership, licenses for retained copies, disclaimers, limits of liability, indemnity, and dispute terms—will survive.
12. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” SPORTSCRED DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND SECURITY.
We do not guarantee that the Service, ACS, sports data, User Content, AI content, or results will be uninterrupted, error-free, current, or suitable for any particular purpose. We are not responsible for User Content, third-party services, external links, or actions users take based on Service content.
Some jurisdictions do not allow certain disclaimers, so some of this section may not apply to you. Nothing in these Terms limits non-waivable consumer rights.
13. Limitation of Liability and Indemnity
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPORTSCRED AND ITS OWNERS, AFFILIATES, PERSONNEL, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OPPORTUNITY, OR REPUTATION, ARISING FROM OR RELATED TO THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPORTSCRED’S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID SPORTSCRED FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US $100.
To the extent permitted by law, you will defend, indemnify, and hold harmless SportsCred and its owners, affiliates, and personnel from claims, damages, losses, liabilities, and expenses arising from your User Content, your unlawful use of the Service, or your material violation of these Terms or another person’s rights.
14. Disputes and Governing Law
Before filing a formal claim, you and SportsCred agree to try in good faith to resolve the dispute for 30 days after one party sends written notice describing the issue and requested resolution. Send notices to thesportscred@gmail.com.
Except where applicable consumer law requires otherwise, these Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any court proceeding must be brought in a court of competent jurisdiction in California, and each party consents to the personal jurisdiction of those courts.
This draft does not include mandatory arbitration or a class-action waiver. Those provisions should be added only after advice from qualified counsel and a deliberate business decision.
15. General Terms
We may update these Terms as the Service or law changes. We will post the revised Terms with a new effective date and provide additional notice when required. If you continue using the Service after updated Terms take effect, you accept them.
We may change, suspend, or discontinue features, and may introduce new limits or requirements. We are not liable for changes where the law permits, but we will honor non-waivable rights.
You may not assign these Terms without our written consent. We may assign them as part of a reorganization, financing, merger, acquisition, or asset transfer. If any provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver. These Terms and the Privacy Policy are the entire agreement about the Service unless additional written terms apply.
